Taxi Driver Exclusion from G.I.E. Upheld Despite Work Freedom Claim
Synthèse Legislator
Généré par l'IAAn individual affiliated with a G.I.E. of taxi drivers challenged his automatic exclusion from the group due to a temporary incapacity to conduct commercial activity, arguing that this exclusion, based on the group's bylaws, illegally restricted his freedom to work and undertake by effectively barring him from accessing the mandatory central radio dispatch system required by a municipal decree. The court rejected the appeal, reasoning that the relevant bylaw was consistent with the law governing G.I.E.s, and the appellant failed to prove that his exclusion from the group caused him to be denied access to the central dispatch, noting that the legality of the municipal decree itself was not for the highest court to assess.

Sur le moyen unique, pris en ses deux branches :
Attendu que M. Hubert X... et le Groupement d'Intérêt économique "Taxis-Radio de Grenoble (le G.I.E.) font grief à l'arrêt confirmatif attaqué (Grenoble, 15 mai 1985) d'avoir déclaré que M. X..., pour avoir été frappé d'incapacité temporaire d'exercer une activité commerciale, était de plein droit exclu du G.I.E. par l'effet de l'article 20 des statuts de ce groupement, alors, selon le moyen, que l'activité de chauffeur artisan taxi étant de nature civile et commerciale et le G.I.E. ne regroupant pas des commerçants, aux termes de l'article 10 de ses statuts, une interdiction de gérer, diriger, administrer ou contrôler une entreprise commerciale n'était pas de nature à justifier l'exclusion d'un tel groupement et qu'à raison de l'arrêté municipal du 31 mai 1978 imposant aux chauffeurs de taxi d'être reliés par radio à un central d'appel unique, l'exclusion du G.I.E., regroupant les artisans taxi, personnes physiques, gérant ce central unique, aboutit à une interdiction d'exercer la profession comportant une restriction illégale à la liberté du travail et à la liberté d'entreprendre ;
Mais attendu que l'article 20 des statuts est conforme aux dispositions de l'article 14 de l'ordonnance n° 67-821 du 23 septembre 1967 sur les G.I.E. et que M. X... n'ayant pas offert d'établir que l'accès au central d'appel unique lui avait été refusé du fait de son exclusion du groupement, il ne saurait soutenir devant la Cour de cassation, à laquelle il n'appartient pas d'apprécier la légalité de l'arrêté municipal, qu'il a été privé de la possibilité d'exercer à Grenoble la profession d'artisan taxi ;
D'où il suit que le moyen ne peut être accueilli ;
Par ces motifs :
