Valuation of Undivided Inherited Property in Partition Suit
Synthèse Legislator
Généré par l'IAThe appellant argued on a single ground that the appellate court erred by relying on an outdated expert valuation from two years prior when assessing the value of undivided inherited property at the time of the 1979 partition, noting the expert report explicitly excluded partition in kind; however, the Court of Cassation rejected the appeal, holding that the appellate judges correctly based their valuation on the 1979 date, reasonably attributing any diminution in value at that time to the property's status as undivided, thus affirming that the lower court did not misinterpret the appellant's submissions.

Attendu que dans ses conclusions en cause d'appel M. Hubert X... a seulement précisé que l'acte de partage dressé le 25 juin 1979, l'avait été en dehors de toute expertise, que l'expertise, à laquelle se référaient les consorts X... avait été réalisée deux ans auparavant, dans le cadre d'une précédente procédure, et que l'expert avait relevé que la consistance immobilière de la succession excluait tout partage en nature ; que les juges du second degré se sont bien placés à la date du partage pour leur évaluation en énonçant qu'en 1979 la diminution de valeur des biens s'expliquait par le fait qu'étant indivis ils avaient été moins bien entretenus ; qu'ainsi la Cour d'appel, qui n'a pas dénaturé les conclusions invoquées, a légalement justifié sa décision ;
