Employee Overtime and Training Contract Appeal Upheld
Synthèse Legislator
Généré par l'IAAn employee appealed a decision that denied her claims for overtime pay and compensation for breach of a training contract, arguing the lower court failed to provide sufficient reasoning. The appellate court found that the lower court adequately justified its ruling by explicitly stating the employee's bi-weekly work schedule averaged 39 hours per week, negating entitlement to overtime, and further concluding that the employee failed to substantiate her claim for damages related to the training contract violation, thus upholding the dismissal of the appeal.

Sur le moyen unique :
Attendu que Mlle X... reproche aux juges du fond d'avoir rejeté ses demandes de rémunération pour heures supplémentaires et d'indemnité pour non-respect du contrat de formation qui l'a liée pendant un an à la société Beaulu, sans avoir donné de motifs à leur décision ;
Mais attendu que le jugement attaqué (Conseil de prud'hommes de Poitiers, 11 septembre 1984) énonce, d'une part, que "l'horaire de travail sur une quinzaine était de 32 heures la première semaine et de 46 heures la seconde, soit au total 78 heures, soit par semaine 39 heures", de sorte que Mlle X... ne pouvait prétendre au paiement d'heures supplémentaires, et, d'autre part, qu'elle ne pouvait justifier sa demande d'indemnité pour non-respect du contrat emploi-formation ; que le Conseil de prud'hommes a ainsi motivé sa décision et que le moyen ne peut donc être accueilli ;
