Landlord Repossession Claim Denied Based on Artisanal Activity Exclusion
Synthèse Legislator
Généré par l'IAThe owner of an apartment sought repossession from the occupants, who were using the premises for their professional activity. The appellate court denied the repossession claim on the basis that the tenants conducted their profession in the apartment, yet the court also acknowledged that the tenant manufactured products offered to clients on site. The Supreme Court quashed the decision because, by finding that the tenant engaged in the manufacturing and creation of goods used in their trade, the appellate court failed to apply Article 22 of the Law of September 1, 1948, which is inapplicable to artisanal activity, thus violating the stated legal provision.

Sur le moyen unique :
Vu l'article 22 de la loi du 1er septembre 1948 ;
Attendu que ce texte ne peut être invoqué dans l'hypothèse d'une activité artisanale ;
Attendu que pour débouter les consorts Y... de leur demande de reprise d'un appartement occupé par les époux X..., l'arrêt attaqué (Aix-en-Provence, 21 novembre 1985) retient que ceux-ci exercent leur profession dans cet appartement ;
Attendu qu'en statuant ainsi, tout en relevant que le locataire fournissait à la clientèle des produits ou valeurs créés par lui après les avoir travaillés ou mis en oeuvre, la Cour d'appel, qui n'a pas tiré les conséquences légales de ses propres constatations a violé le texte susvisé ;
PAR CES MOTIFS :
CASSE et ANNULE l'arrêt rendu le 21 novembre 1985, entre les parties, par la Cour d'appel d'Aix-en-Provence ; remet, en conséquence, la cause et les parties dans l'état où elles se trouvaient avant ledit arrêt et, pour être fait droit, les renvoie devant la Cour d'appel de Nîmes, à ce désignée par délibération spéciale prise en la Chambre du conseil ;
