Hairdresser Seniority and Qualification Classification Dispute
Synthèse Legislator
Généré par l'IAAn appellate court refused to grant an employee the higher classification coefficient (180) under the national collective agreement for hairdressing, despite acknowledging over 17 years of seniority, because the employee purportedly failed to justify his "high qualification." The highest court overturned this decision, reasoning that the collective agreement explicitly grants the specified echelon to a highly qualified worker who either holds a specific diploma or has fifteen years of professional experience as a hairdresser, meaning the appellate court improperly added the requirement of justifying "high qualification" beyond the stated tenure criterion, thus violating the agreement.

Sur le moyen unique :
Vu l'article 3 annexe 1 de la Convention collective nationale de la coiffure ;
Attendu que pour rejeter la demande de M. Gilbert X... tendant à obtenir une qualification au coefficient 180 de la convention collective nationale de la coiffure, la Cour d'appel a énoncé que s'il n'était pas contesté que M. X... avait plus de 17 ans d'ancienneté, il n'apportait pas la moindre justification de sa "haute qualification" ;
Qu'en statuant ainsi, alors que la convention prévoit qu'appartient "au 5ème échelon de la 2ème catégorie, l'ouvrier hautement qualifié titulaire du B.P. ou du B.M. ou ayant quinze ans d'exercice de la profession de coiffeur", la Cour d'appel a ajouté une condition supplémentaire à la classification dans le 5ème échelon, qu'elle ne comporte pas et par là, violé la convention susvisée ;
