Aero-Club v. Autopilot Installer Liability Appeal
Synthèse Legislator
Généré par l'IAThe court rejected an appeal concerning liability for an aircraft autopilot, where the lower court found that the appellant (an aero-club) failed to prove the appellee exclusively performed the installation work, presenting only correspondence from a third-party company about the repair and adjustment of the autopilot. The appellate court was justified in ruling that a mere transactional offer of repair made by the appellee during the expert assessment was insufficient, on its own, to establish the appellee's liability, as the court properly weighed the evidence presented, including testimony that the appellee refused the work due to a lack of technical documentation.

X... seul, ils ont estimé que l'offre transactionnelle de réparer, faite par ce dernier au cours de l'expertise, ne pouvait à elle seule fonder sa responsabilité ; que la Cour d'appel, qui n'avait pas à répondre à des conclusions que sa décision rendait inopérantes, a ainsi légalement justifié sa décision ; d'où il suit que le moyen n'est fondé en aucune de ses quatre branches ;
