Employer Dismissal Upheld Over Intoxicated Driver's Accident
Synthèse Legislator
Généré par l'IAAn employer dismissed an employee, hired as a driver-delivery person, following a traffic accident caused by the employee's intoxication, evidenced by a blood alcohol level of 2.17 grams, which was deemed a real and serious cause for dismissal but not gross misconduct by the appellate court, which consequently ordered the employer to pay termination indemnities; the Supreme Court quashed this part of the ruling, finding that the severity of the fault justified immediate termination under the Labor Code articles, and referred the matter back to a different appellate court solely regarding the payment of termination indemnities.

Sur le moyen unique :
Vu les articles L. 122-6 et L. 122-9 du Code du travail ;
Attendu que la société SOMODIS a engagé M. X... le 18 septembre 1979 en qualité de chauffeur-livreur et l'a licencié le 5 juin 1982 après qu'il eut provoqué un accident de la circulation sous l'empire d'un état alcoolique caractérisé par un taux d'alcoolémie de 2,17 grammes ;
Attendu que l'arrêt attaqué l'a condamnée au paiement des indemnités de rupture au motif que ce fait unique, s'il constituait une cause réelle et sérieuse de licenciement, ne caractérisait pas la faute grave ;
Qu'en statuant ainsi, alors que la gravité de la faute commise par le salarié justifiait la rupture immédiate du contrat de travail, la Cour d'appel a violé les textes susvisés ;
PAR CES MOTIFS :
CASSE et ANNULE mais seulement en celle de ses dispositions relative aux indemnités de rupture, l'arrêt rendu le 9 mars 1984, entre les parties, par la Cour d'appel de Besançon ; remet, en conséquence, quant à ce, la cause et les parties dans l'état où elles se trouvaient avant ledit arrêt et, pour être fait droit, les renvoie devant la Cour d'appel de Dijon, à ce désignée par délibération spéciale prise en la Chambre du conseil ;
