Sur le moyen unique du pourvoi incident :
Vu l'article L. 122-6 du Code du travail ;
Attendu que pour condamner la société des Transports Vialle et Fils à payer à M. X... une indemnité de préavis, l'arrêt attaqué a énoncé que ce salarié pouvait légitimement prétendre au bénéfice de l'indemnité en raison de son ancienneté, dès lors que l'employeur n'invoquait pas expressément une faute grave contre lui ;
Attendu cependant que l'employeur n'est pas tenu de verser au salarié une indemnité compensatrice d'un préavis à un salarié qui n'a pas offert de fournir la prestation de travail et qu'en statuant comme elle l'a fait, tout en constatant que M. X... n'avait jamais repris son travail dans l'entreprise, la Cour d'appel a violé les dispositions du texte susvisé ;
PAR CES MOTIFS :
CASSE ET ANNULE, mais seulement en celle de ses dispositions condamnant la société des Transports Vialle et Fils à payer à M. X... une indemnité compensatrice de préavis, l'arrêt rendu, le 28 février 1985, entre les parties, par la Cour d'appel de Bordeaux ; remet, en conséquence, quant à ce, la cause et les parties dans l'état où elles se trouvaient avant ledit arrêt et, pour être fait droit, les renvoie devant la Cour d'appel de Limoges, à ce désignée, par délibération spéciale prise en la Chambre du conseil ;
