Teacher's Appeal of Written Warning Upheld Despite Procedural Dispute
Synthèse Legislator
Généré par l'IAAn employee, a dance teacher, appealed a decision upholding a formal written warning, arguing that the employer failed to hold a prerequisite interview, a point the appellate court allegedly ignored, thus violating the procedural code. The high court rejected this appeal, affirming that under the applicable labor code article, the employer is not required to follow the procedure outlined in the second paragraph of that article when the disciplinary measure is only a formal written warning, thereby establishing that the appellate court sufficiently addressed the employee's argument.

Sur le moyen unique :
Attendu que Mme X..., employée par Mme Y... en qualité de professeur de danse, fait grief à l'arrêt attaqué (Pau, 15 novembre 1984) d'avoir dit n'y avoir lieu à prononcer l'annulation de l'avertissement qui lui a été notifié par son employeur le 9 mai 1984 alors qu'elle avait soutenu devant les juges du fond qu'un avertissement écrit devait faire l'objet d'un entretien préalable et qu'en ne répondant pas sur ce point à ses conclusions, la Cour d'appel a violé l'article 455 du nouveau Code de procédure civile ;
Mais attendu que l'arrêt, qui a exactement énoncé qu'aux termes de l'article L.122-41 du Code du travail, lorsque la sanction envisagée est un avertissement, l'employeur n'est pas tenu d'observer la procédure prévue par le deuxième alinéa dudit article, la Cour d'appel a ainsi répondu aux conclusions prétendument délaissées ;
D'où il suit que le moyen n'est pas fondé ;
