Seller Incapacity in Contract Consent Dispute
Synthèse Legislator
Généré par l'IAThe court upheld the rejection of an appeal arguing that the seller lacked the capacity to consent to a sale, holding that the burden of proving this incapacity rested with the claimant; the lower court's assessment, which considered medical certificates and other attestations indicating the seller's poor health in 1977 but found insufficient evidence to prove she was incapable of manifesting her will during the sale, did not improperly shift the burden of proof or improperly categorize a subsequent 1981 agreement as a confirmation of the earlier act, thus remaining within the proper scope of assessing consent at the time of the original transaction.

Sur le moyen unique, pris en ses trois branches, tel qu'il figure au mémoire ampliatif et est reproduit en annexe :
Attendu qu'il appartenait à Mme X..., qui prétendait n'avoir pas eu la capacité de disposer à l'époque de la vente, d'en apporter la preuve ; que c'est sans inverser la charge de celle-ci que les juges du second degré ont relevé que Mme X... produisait, outre un certificat médical rédigé en 1981 et attestant qu'en 1977 elle était très fatiguée et n'avait pas les idées claires et lucides, sept autres attestations qui, si elles mentionnaient son mauvais état de santé en 1977, n'établissaient pas davantage que l'intéressée avait été hors d'état de manifester sa volonté lors de la vente ; que la Cour d'appel, qui ne s'est pas fondée sur la notion de renonciation à un droit, et qui n'a pas qualifié d'acte de confirmation ou de réitération, l'acte intervenu en 1981 et portant constitution d'un droit d'usage sur une des parcelles précédemment vendues, s'est seulement placée au plan de l'appréciation du consentement donné lors de la vente antérieure ; que la décision est donc légalement justifiée ;
D'où il suit que le moyen n'est fondé en aucune de ses trois branches ;
