Appeal Regarding Electoral Roll Registration Based on Parental Domicile
Synthèse Legislator
Généré par l'IAThe case involved an appeal against a lower court's refusal to register two newly-majority individuals on the electoral rolls of a commune, despite their parents residing and being registered there, with the appellants claiming the young adults maintained their parents' domicile while being university students elsewhere. The high court upheld the refusal, reasoning that the lower court correctly determined that the applicants failed to establish their parents actually maintained a domicile in the commune, as the parents' registration on the electoral lists alone did not create a presumption of domicile, which was a factual finding within the trial court's sovereign power of appreciation.

Sur le moyen unique :
Attendu qu'il est fait grief au jugement attaqué (Tribunal d'instance de Sartène, 12 mars 1987) d'avoir refusé l'inscription, sur les listes électorales de la commune de Propriano, de MM. X... et Y... qui avaient atteint leur majorité, alors que ces électeurs, à la charge de leurs parents, auraient conservé le domicile de ceux-ci, qui étaient résidents et électeurs à Propriano ;
Mais attendu que le tribunal retient que les deux jeunes gens, étudiants hors de Corse, n'établissaient pas que leurs parents aient eu un domicile à Propriano, l'inscription de ceux-ci sur les listes électorales de cette commune ne créant pas une présomption à cet égard ;
Que par ces énonciations, qui relèvent de son pouvoir souverain d'appréciation, le tribunal d'instance a légalement justifié sa décision ;
