Appeal Regarding Spousal Support Calculation Following Shared-Fault Divorce
Synthèse Legislator
Généré par l'IAThe appeal challenged a decision granting spousal support following a divorce decreed with shared fault, arguing the appellate court erred by basing the award on irrelevant factors like the length of the marriage and the wife's professional collaboration, and by misinterpreting the wife's stated salary in her own filings. The high court rejected the appeal, reasoning that the appellate court was entitled to consider the duration of the marriage and spousal contribution when assessing the disparity in resources, and further, that the salary figure used by the court matched what the appellant had asserted in her final submissions, thus precluding claims of misinterpretation or exceeding the scope of the dispute.

Sur le moyen unique, pris en ses deux branches :
Attendu qu'il est fait grief à l'arrêt attaqué (Lyon, 19 février 1985), qui a prononcé le divorce des époux D. P.-C. à leurs torts partagés, d'avoir alloué à la femme une prestation compensatoire alors que, d'une part, la Cour d'appel se serait fondée sur des considérations inopérantes relatives à la durée de la vie commune et à la collaboration de la femme à la profession de son mari, ce qui aurait faussé son appréciation, et alors que, d'autre part, elle aurait, en attribuant à la femme un salaire inférieur à celui reconnu par celle-ci, dénaturé ses conclusions et violé l'article 4 du nouveau Code de procédure civile ;
Mais attendu que la Cour d'appel, qui a retenu la disparité des ressources des époux, qu'elle analyse dans son arrêt, pouvait prendre en considération la durée de la vie commune et la collaboration de la femme à la profession de son mari ;
Et attendu que, dans ses dernières conclusions, Mme D. P. faisait état du salaire mensuel retenu par l'arrêt qui n'a dons commis, ni la dénaturation, ni la modification des limites du litige invoquées par le pourvoi :
D'où il suit que le moyen ne peut être accueilli ;
PAR CES MOTIFS :
REJETTE le pourvoi
