Appeal Regarding Unpaid Wages and Unfair Dismissal Dismissed
Synthèse Legislator
Généré par l'IAAn employer appealed a decision ordering it to pay an employee sums for unpaid wages, termination indemnities, and damages for unfair dismissal, arguing the lower court had distorted facts, failed to rule on key defenses concerning the employee's lack of managerial status and refusal to work, lacked sufficient reasoning by vaguely attributing the rupture to the employer's strange behavior, and failed to classify the nature of the termination. The high court dismissed the appeal, reasoning that misinterpretation of facts is not grounds for cassation, the lower court had implicitly responded to the employer's arguments by affirming the employee's executive status and finding the employer prevented the employee from working, the reasoning sufficiently established the employer's responsibility for the termination by noting the refusal to allow work without fault being alleged by the employer, and the termination was properly characterized as being without just and serious cause and attributable to the employer rather than employee resignation.

Sur les quatre moyens réunis :
Attendu que la société S.A.M.A.C.O. fait grief à l'arrêt attaqué (Nîmes, 24 janvier 1984) de l'avoir condamnée à payer à M. X..., à son service du 23 avril 1979 au 6 janvier 1982, diverses sommes à titre de reliquat de congés payés, d'indemnités de rupture et d'indemnité pour licenciement sans cause réelle et sérieuse, alors, en premier lieu, que la Cour d'appel a dénaturé les faits, qu'en second lieu, elle n'a pas répondu aux conclusions de la société ayant fait valoir que le salarié n'avait pas la qualité de chef du personnel et avait refusé de travailler, alors, en outre, qu'en se bornant à affirmer qu'il était évident que la rupture du contrat de travail était imputable au comportement pour le moins étrange de l'employeur, la Cour d'appel n'a pas motivé sa décision, alors, enfin, qu'elle s'est abstenue de qualifier la nature de la rupture ;
Mais attendu, d'une part, que le grief de dénaturation des faits n'est pas un cas d'ouverture à cassation ; que, d'autre part, en confirmant la décision des premiers juges qui avaient reconnu au salarié la qualité de cadre et en retenant que celui-ci s'était présenté à son travail du 5 octobre 1981 au 5 janvier 1982 sans être admis à travailler, la Cour d'appel a répondu aux conclusions prétendument délaissées ; qu'en outre, ayant retenu que l'employeur avait refusé de laisser travailler le salarié et n'avait reproché aucune faute à celui-ci, la Cour d'appel a suffisamment motivé sa décision imputant la rupture à l'employeur ; qu'enfin, elle a caractérisé la nature de la rupture, en estimant que celle-ci n'était pas due à la démission du salarié, mais était imputable à l'employeur, et que cette rupture était intervenue en l'absence d'une cause réelle et sérieuse ;
Qu'il s'ensuit qu'aucun des moyens ne peut être accueilli ;
