Occupying Spouse Indemnity Upheld Despite Spousal Support Ruling
Synthèse Legislator
Généré par l'IAThe court upheld the decision that an occupying spouse could be ordered to pay an occupancy indemnity, rejecting the argument that an earlier ruling on spousal support implicitly accounted for the free use of the marital home; the appellate court reasonably determined from the non-conciliation order that the free enjoyment of the property was not explicitly granted to the wife, and the husband's contribution to loan repayments did not preclude an occupancy charge, thus legally justifying the ruling without violating the authority of the prior judgment.
