Breach of Promise to Marry and Occupation Indemnity Appeal
Synthèse Legislator
Généré par l'IAThe appellant sought to overturn a decision that rejected her claim concerning the breach of a promise to marry and an award of an occupation indemnity, arguing the lower court failed to properly assess the fault for the rupture and her status regarding the property. The appellate court was upheld because it correctly determined that the appellant, who held full-time employment, could not simultaneously claim collaboration in the appellee's business, and critically, failed to prove any fault on the part of the appellee for the broken promise, confining herself to demanding justification rather than proving the fault; furthermore, the finding that the appellant was occupying the premises without right legally supported the imposition of an occupation indemnity.

REJETTE le pourvoi ;
