Co-Producer Fund Seizure Litigation
Synthèse Legislator
Généré par l'IAA co-producer, having advanced funds to a film project via an agreement with one of the initial co-producers, subsequently brought claims and seized assets belonging to a third co-producer, asserting a right to be informed of the film's revenue based on the contract. The appellate court ordered the return of the seized funds and awarded damages, reasoning that the claimant had no contractual relationship obligating the third co-producer, despite occasional communication regarding the film's progress, as only the claimant and the contracting co-producer were signatories to the agreement, thereby correctly limiting obligations only to the parties who subscribed to the convention.

Sur le moyen unique :
Attendu, selon l'arrêt confirmatif attaqué, (Paris, 27 septembre 1985) que la société Cathala, qui avait pris une part dans la production d'un film co-produit avec les sociétés Belstar et Multimedia, a passé le 14 août 1979 une convention avec M. X... selon laquelle elle avancerait avec celui-ci à la co-production de ce film une certaine somme qui serait remboursée en fonction du chiffre d'affaires réalisé ; que M. X... estimant que l'obligation d'être tenu au courant de l'évolution de ce chiffre d'affaires incombait à la société Belstar a fait pratiquer diverses saisies sur les comptes de celle-ci ;
Attendu que M. X... reproche à la Cour d'appel d'avoir ordonné la restitution à la société Belstar de la somme consignée et de l'avoir condamné au paiement de dommages-intérêts, alors, selon le pourvoi, que du fait de la convention passée avec la société Cathala, M. X... est devenu co-producteur avec celle-ci du film, disposant avec elle d'un pouvoir de contrôle direct dans la distribution ; que la Cour d'appel qui constatait que la société Belstar avait spontanément exécuté à l'égard de M. X... ladite convention, ne pouvait méconnaître l'adhésion de cette société à la convention rendue à elle et par elle opposable, qui reconnaissait à M. X... sa qualité de producteur, et les droits s'y rattachant ; qu'en statuant comme elle l'a fait, la Cour d'appel n'a pas tiré de ses propres constatations les conséquences qui en résultaient ; que l'arrêt attaqué a violé l'article 1165 du Code civil ;
Mais attendu qu'ayant constaté par motifs propres et adoptés que la société Belstar n'avait pris aucun engagement avec M. X... même s'il lui était arrivé, pendant une certaine période d'avoir tenu ce dernier au courant de la marche du film et que les seuls signataires du contrat étaient les sociétés Cathala et X..., la Cour d'appel qui a exactement retenu que la convention n'avait pu engendrer d'obligations qu'entre les seules parties qui l'avaient souscrite a légalement justifié sa décision ; d'où il suit que le moyen n'est pas fondé ;
