Synthèse Legislator

The Court of Cassation rejected an appeal concerning the division of costs for maintaining a servitude pathway, affirming the lower court's finding that the owners of the servient estate were responsible for clearing their ditch, and upholding the appellate court's discretionary apportionment of maintenance costs between the dominant and servient estate owners, as no specific legal text dictated a mandatory cost-sharing formula for the upkeep of such a path.
