Contractor v. Tile Supplier: Warranty Claims and Statute of Limitations on Hidden Defects
Synthèse Legislator
Généré par l'IAIn an action for roof defects brought by the building owner against a contractor, the contractor sought to invoke a warranty from its tile supplier, who in turn sought warranty from the tile manufacturer and its insurer; after an initial judgment addressed the main claim but rejected the third-party claims, the contractor re-filed its action against the supplier, who again brought claims against the now-liquidated manufacturer and its insurer, leading the manufacturer and insurer to argue that the cross-claim filed in February 1983, following the initial 1981 judgment against the contractor, was time-barred under the relevant civil code provision regarding hidden defects; the Court of Cassation rejected this argument, finding that the Court of Appeal had reasonably determined the action was brought without undue delay, as it noted the contractor had been sued in November 1980, called the supplier as a warrantor during that procedure, and reiterated the warranty claim in February 1983.

Sur le moyen unique :
Attendu, selon l'arrêt attaqué (Dijon, 2 octobre 1985), que dans une action en réparation de désordres en toiture intentée par le maître de l'ouvrage contre l'entreprise société Pougez, Père et Fils, celle-ci a, en cause d'appel, réclamé la garantie de son fournisseur de tuiles, la société Lexcellent, laquelle a formé une demande de même nature à l'encontre tant du fabricant de matériaux, la société Tuileries de Saint-Parres Les Vaudes, que de la S.M.A.B.T.P., assureur de cette dernière ; qu'un premier arrêt du 11 février 1983 ayant fait droit à la demande principale mais ayant déclaré irrecevables les recours, la société Pougez a introduit une action principale à l'encontre de la société Lexcellent, qui a réitéré ses prétentions contre la société Tuileries de Saint-Parres, en état de règlement judiciaire assistée du syndic, M. Contant et la S.M.A.B.T.P. ;
Attendu que la société fabricante de tuiles, devenue en état de liquidation des biens, représentée par M. Contant, syndic, et son assureur font grief à l'arrêt d'avoir déclaré recevable, comme intentée à bref délai, l'action récursoire introduite en février 1983 contre le fabricant de tuiles, par le constructeur déclaré responsable par jugement du 25 juillet 1981 des dommages subis par le maître de l'ouvrage, alors, selon le moyen, "qu'en ne précisant pas à quelle date cette première demande en garantie avait été formée et quel délai la séparait du jugement prononçant condamnation du constructeur, l'arrêt attaqué, qui n'établit pas la durée et le point du délai imparti à ce dernier pour exercer son droit, n'a pas donné de base légale à sa décision, au regard de l'article 1648 du Code civil" ;
Mais attendu qu'ayant relevé qu'après avoir été assignée le 25 novembre 1980 par le maître de l'ouvrage, la société Pougez avait, au cours de la procédure suivie sur cette assignation, appelé en garantie la société Lexcellent et réitéré sa demande par acte du 28 février 1983, la Cour d'appel a souverainement retenu que l'entreprise avait exercé à bref délai l'action récursoire contre le fournisseur ;
D'où il suit que le moyen n'est pas fondé ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
