Appeal Regarding Unremoved Stones After Demolition Order Enforcement
Synthèse Legislator
Généré par l'IAThe appellant sought to have the lower court's decision rejected on the grounds that the appellee failed to comply with a prior judgment ordering the demolition of a wall and restoration of the premises, specifically by leaving behind an accumulation of stones that allegedly obstructed access. The Court of Cassation rejected the appeal, affirming that the lower court reasonably concluded that the appellee had executed the demolition order by removing the wall they had constructed and leaving only the pre-existing accumulation of stones, thereby satisfying the terms of the condemnation.

Sur le moyen unique :
Attendu que M. Y... fait grief à l'arrêt attaqué (Dijon, 5 décembre 1984) de l'avoir débouté de sa demande tendant à faire juger que son voisin, M. X..., n'avait pas satisfait à l'exécution d'un arrêt prescrivant la démolition d'un mur et la remise des lieux dans l'état où ils étaient immédiatement avant son édification, alors, selon le moyen, "qu'en ne recherchant pas si l'amas de pierres laissé par M. X... entravait le passage des engins indiqués par les témoins, ainsi que le soutenait M. Y..., la Cour d'appel n'a pas donné de base légale à sa décision au regard de l'article 1143 du Code civil" ;
Mais attendu qu'après avoir constaté l'existence d'un ancien amas de pierres à l'endroit où le mur avait été remonté par M. X..., l'arrêt retient souverainement que ce dernier avait démoli la partie du mur par lui édifiée, et, qu'ayant laissé subsister les vestiges du mur tels qu'ils étaient antérieurement à la construction, il avait exécuté la condamnation prononcée contre lui ;
D'où il suit que le moyen n'est pas fondé ;
