Expropriation Compensation Valuation Date Dispute
Synthèse Legislator
Généré par l'IAThe expropriating entity challenged the appellate court's decision on the amount of compensation awarded to the property owners following a declaration of public utility, arguing the decision was insufficiently reasoned because it failed to specify the valuation date, asserting that valuation must occur as of the date of the first instance judgment. The high court rejected this appeal, reasoning that because the Court of Appeal maintained the price per square meter set by the initial judge and used a valuation method involving the average of that price and a calculation based on the property's last known income at the time of the initial judgment, the appellate court necessarily evaluated the expropriated property as of the date of the first instance decision, thus satisfying the legal requirement.

La Cour ;
Sur le premier moyen :
Attendu que la Société d'équipement de la région lyonnaise fait grief à l'arrêt attaqué (Lyon, 18 novembre 1982) qui, à la suite de l'expropriation pour cause d'utilité publique prononcée à son profit, fixe l'indemnité due aux consorts X..., de ne pas avoir précisé la date d'évaluation du bien exproprié, alors, selon le moyen, "que les biens expropriés doivent être évalués à la date de la décision de première instance ; qu'en statuant comme elle l'a fait, sans préciser la date à laquelle elle se plaçait pour estimer l'immeuble litigieux la Cour d'appel a privé sa décision de base légale au regard de l'article L. 13-15 du Code de l'expropriation" ;
Mais attendu que l'arrêt, après avoir maintenu le prix au mètre carré alloué par le premier juge, pour le bien exproprié, au moyen de la méthode d'évaluation par comparaison, fixe l'indemnité de l'expropriation en établissant la moyenne de ce prix et de celui obtenu par la méthode d'évaluation de cet immeuble par le dernier revenu connu lors du jugement ; qu'ainsi, la Cour d'appel a nécessairement évalué le bien exproprié à la date de la décision de première instance ;
D'où il suit que le moyen n'est pas fondé ...
Par ces motifs :
Rejette le pourvoi formé contre l'arrêt rendu le 18 novembre 1982 par la Cour d'appel de Lyon.
