Occupants v. Eviction Order on Hotel Status and Prior Commercial Lease Law
Synthèse Legislator
Généré par l'IAOccupants of a furnished hotel property contested their eviction order by asserting tenant status, arguing that the appellate court erred in classifying their arrangement as a hotel contract without confirming the provision of services characteristic of such a contract. The high court dismissed the appeal, upholding the lower court's decision on the sole ground that the occupants occupied furnished premises previously governed by the 1949 law relating to the cessation of the lessor's commercial activity, which sufficiently justified the eviction order based on the nature of the occupancy.

Sur le moyen unique :
Attendu que M. X... X... et consorts, occupants d'un immeuble à usage d'hôtel meublé acquis par M. Y..., font grief à l'arrêt attaqué (Versailles, 11 juillet 1984) d'avoir, pour ordonner leur expulsion, retenu qu'ils étaient logés en vertu d'un contrat d'hôtellerie, alors, selon le moyen, " que M. X... et consorts ayant, dans leurs conclusions devant la Cour d'appel, invoqué leur qualité de locataires en meublé, l'arrêt attaqué, qui affirme qu'ils étaient bénéficiaires d'un contrat d'hôtellerie sans constater qu'ils aient bénéficié des services et de la surveillance caractérisant le contrat d'hôtellerie, a entaché sa décision d'un défaut de motifs et violé l'article 455 du nouveau Code de procédure civile " ;
Mais attendu que l'arrêt, qui retient, par motifs propres et adoptés, que MM. X... et consorts occupaient des locaux meublés soumis, avant la cessation de l'activité commerciale du bailleur, au régime de la loi du 2 avril 1949, est, par ces seuls motifs, légalement justifié ;
