Expropriation Order Cassation: Notification Timing and Procedural Defect Claims Dismissed
Synthèse Legislator
Généré par l'IAAn individual sought the cassation of an expropriation order, first arguing that the underlying public utility and transferability decrees should be annulled, but this first ground was rendered moot by a definitive administrative tribunal judgment rejecting the challenge to those decrees. Secondly, the appellant claimed procedural irregularity because individual notifications regarding the deposit of the file at the town hall were received concurrently with or after the opening date of the parcel survey, violating expropriation regulations; however, the court dismissed this, finding that the notification acknowledgment was postmarked prior to the survey's opening, and further reasoning that the appellant could not claim defects that did not concern him.

Texte complet
Sur le premier moyen ;
Attendu, que M. X... demande la cassation de l'ordonnance attaquée (juge de l'expropriation du département du Pas-de-Calais, 27 avril 1981) en conséquence de l'annulation des arrêtés déclarant l'utilité publique et la cessibilité sur la base desquels a été prononcée cette ordonnance ;
Mais attendu, que le tribunal administratif de Lille ayant, par jugement du 4 mars 1982, définitif, rejeté le recours, le moyen est devenu sans objet ;
Sur le second moyen ;
Attendu, qu'il est reproché à l'ordonnance d'avoir été prononcée au vu de notification individuelle du dépôt du dossier en mairie dont l'accusé de réception est concomittant ou postérieur à la date d'ouverture de l'enquête parcellaire fixée au 19 mai 1980, alors, selon le moyen, "que les notifications individuelles du dépôt du dossier en mairie doivent être préalables à l'ouverture de l'enquête, une notification tardive constituant une violation des articles R. 11-20 et R. 11-22 du Code de l'expropriation" ;
Mais attendu, que l'enquête s'étant déroulée du 19 mai au 6 juin 1980 et l'avis de réception de la notification à M. X... étant timbré du 17 mai 1980, il n'existe aucune irrégularité et que l'intéressé ne peut se prévaloir de vices de forme qui ne le concernent pas ; d'où il suit que le moyen n'est pas fondé ;
PAR CES MOTIFS :
