Appeal Regarding Liability for Injury from Alcohol Spread on Grass
Synthèse Legislator
Généré par l'IAThe case concerns an appeal following an explosion caused when an individual spread rubbing alcohol on cut grass on her property, resulting in burns to a nearby minor and her father, who subsequently sought damages from the responsible party and her insurer. The appellant argued the appellate court erred by sharing liability based solely on article 1382 of the Civil Code, rather than fully considering article 1384, paragraph 1, which might preclude shared responsibility, or by partially exonerating the guardian despite predictable third-party behavior. The Court of Cassation rejected the appeal, affirming that the guardian of an object causing damage can be partially exonerated if they prove the victim's fault contributed to the harm, and the lower court, having established that the fault of the injured parties contributed to the damage alongside the actions of the responsible party, had the sovereign power to apportion the liability fairly under both relevant civil code articles.

Texte complet
Sur le moyen unique, pris en ses deux branches :
Attendu, selon l'arrêt confirmatif attaqué, (Orléans, 1er février 1985) que Mme Y..., pour enflammer des herbes qui avaient été fauchées sur sa propriété, a répandu sur celles-ci de l'alcool à brûler, provoquant ainsi une explosion au cours de laquelle la mineure Carole X... qui se trouvait à proximité en compagnie de son père, a subi des brûlures ; que M. X... a demandé à Mme Y... et à son assureur, la M.G.A., la Mutuelle Générale d'Assurance réparation de son préjudice personnel et de celui de sa fille ;
Attendu qu'il est fait grief à l'arrêt d'avoir partagé entre Mme Y... et M. X... la responsabilité des dommages sur le seul fondement de l'article 1382 du Code civil, alors que, d'une part, la Cour d'appel, saisie sur le double fondement des articles 1382 et 1384, alinéa 1 du Code civil, auraît dû rechercher si l'application du dernier de ces textes n'excluait pas un partage de responsabilité, et alors que, d'autre pat, la cour d'appel n'aurait pu exonérer partiellement le gardien de sa responsabilité, tout en constatant que le comportement de la victime et de son père avait été parfaitement prévisible pour lui ;
Mais attendu que le gardien de la chose instrument du dommage est partiellement exonéré de sa responsabilité s'il prouve que la faute de la victime a contribué au dommage ;
Et attendu que la Cour d'appel ayant retenu, en des motifs non critiqués, que M. X... et sa fille avaient commis des fautes qui, avec celles de Mme Y..., avaient concouru à la réalisation du dommage, a partagé entre eux la responsabilité dans des proportions qu'elle a souverainement appréciées, et a ainsi légalement justifié sa décision, tant au regard de l'article 1384, alinéa 1 que de l'article 1382 du Code civil ;
D'où il suit que le moyen n'est pas fondé ;
