Treasurer Priority Overruled in Distribution of Seizure Proceeds
Synthèse Legislator
Généré par l'IAIn a distribution of proceeds following a seizure, the order of payment initially ranked a principal treasurer first, a bank second with a mortgage claim, and another bank third; when the third-ranked bank appealed only the first-ranking creditor's priority, the second-ranked bank sought via an incidental appeal to have its own claim augmented by accrued interest, but the Court of Appeal rejected this, reasoning that as an appellee it was not prevented from seeking payment otherwise, which decision the highest court overturned because the appellate court violated the procedural rule stating that interest for ranked creditors only ceases on the day of definitive settlement.

Sur le moyen unique, pris en sa seconde branche :
Vu l'article 765, alinéa 2, du Code de procédure civile ;
Attendu que les intérêts des créanciers colloqués ne cessent à l'égard de la partie saisie qu'au jour du règlement définitif ;
Attendu selon l'arrêt attaqué, que dans une procédure d'ordre à l'audience, le tribunal avait colloqué, au premier rang et à titre privilégié, le Trésorier principal de Versailles, au deuxième rang et à titre hypothécaire la Société Générale et au troisième rang, la Banque Populaire de la région ouest de Paris ; que celle-ci a relevé un appel limité à la critique de la collocation du Trésorier principal ; que la Société Générale a par voie d'appel incident, demandé que sa propre collocation fût majorée des intérêts échus depuis le jugement ;
Attendu que pour rejeter l'appel incident, la Cour d'appel énonce que bien qu'intimée, la Société Générale n'était pas démunie de moyens pour obtenir le paiement de sa créance et que l'appel de la Banque Populaire n'était pas fautif ;
Qu'en statuant ainsi, elle a violé le texte susvisé ;
PAR CES MOTIFS :
CASSE et ANNULE l'arrêt rendu le 29 octobre 1985, entre les parties, par la Cour d'appel de Versailles ; remet, en conséquence, la cause et les parties dans l'état où elles se trouvaient avant ledit arrêt et, pour être fait droit, les renvoie devant la Cour d'appel d'Angers, à ce désignée par délibération spéciale prise en la Chambre du conseil ;
