A request for a conflict of jurisdiction ruling was submitted by the public prosecutor following a decision by the trial court declaring itself incompetent to judge a case concerning a charge of insubordination, based on the assertion that the matter fell under the specialized military jurisdiction, which conflicted with the prior order from the investigating judge who had referred the accused to the local criminal trial court. The Court resolved the negative conflict by deeming the investigating judge's initial order void, and transferred the case, along with the accused, to the specialized military division of the Grenoble criminal trial court to rule on both the merits of the charge and the issue of jurisdiction after reviewing the existing investigation and any necessary supplementary information.

LA COUR,

Vu la demande en règlement de juges formée par le procureur de la République près le tribunal de grande instance de Valence dans le procès instruit contre X... Thierry, prévenu d'insoumission ;

Vu les articles 657, 697 et suivants du Code de procédure pénale ;.

Attendu que, par ordonnance du juge d'instruction au tribunal de grande instance de Valence en date du 10 février 1987 le susnommé a été renvoyé devant le tribunal correctionnel de Valence comme prévenu du délit ci-dessus spécifié ;

Attendu que, par jugement du 12 août 1987 le tribunal correctionnel de Valence s'est déclaré incompétent au motif que les faits relèvent de la compétence de la juridiction spécialisée en matière militaire ;

Attendu que, de l'ordonnance et du jugement précités, passés en force de chose jugée et contradictoires entre eux, résulte un conflit négatif de juridiction qui interrompt le cours de la justice et qu'il importe de faire cesser ;

REGLANT DE JUGES, sans s'arrêter à l'ordonnance du juge d'instruction, laquelle sera considérée comme non avenue, renvoie la cause et le prévenu en l'état où ils se trouvent devant le tribunal correctionnel de Grenoble en sa formation spécialisée en matière militaire qui, au vu de l'instruction déjà faite et de tout supplément d'information, s'il y a lieu, statuera, tant sur la prévention que sur la compétence ;

ORDONNE, que le présent arrêt sera notifié à qui de droit.
