The appellate court erred by ruling against the mandatory confiscation of a seized weapon following a hunting violation, despite acknowledging the defendant hunted before the legally permitted time stipulated by a ministerial decree, because Article 379, paragraph 2 of the Rural Code mandates confiscation unless the offense was committed by a licensed hunter *during the time hunting is authorized*; the appellate court wrongly interpreted the exception to apply merely because the individual possessed a license and hunting was generally open during that season, overlooking the specific time-of-day restriction violation, necessitating the cassation and referral for a new ruling.
