Mason's Appeal on Witness Disclosure and Judgment Notation Accuracy
Synthèse Legislator
Généré par l'IAAn employee, hired as a mason, appealed a lower court's decision regarding his dismissal, arguing that the lower court improperly admitted three witness attestations that were only disclosed to his counsel at the hearing, and further contesting the accuracy of a judgment notation stating the employer paid a specific sum and provided a vacation certificate at the bar. The Court of Cassation rejected the appeal, reasoning that the communication of the attestations was valid because they were subjected to contradictory discussion without any formal objection, and concluding that the notation in the judgment regarding the payment and certificate must be accepted as accurate until formally challenged via an inscription in forgery procedure.

AU NOM DU PEUPLE FRANCAIS
LA COUR DE CASSATION, CHAMBRE SOCIALE,
a rendu l'arrêt suivant :
Sur le pourvoi formé par M. Jacques Y..., demeurant à Valgorge, l'Estrade (Ardèche),
en cassation d'un jugement rendu le 29 septembre 1988 par le conseil de prud'hommes d'Aubenas (section industrie), au profit de M. Jean-Louis X..., demeurant à Valgorge, Chastenet (Ardèche),
défendeur à la cassation ;
LA COUR, composée selon l'article L. 131-6, alinéa 2, du Code de l'organisation judiciaire, en l'audience publique du 20 septembre 1990, où étaient présents : M. Waquet, conseiller le plus ancien faisant fonction de président et rapporteur, MM. Renard-Payen, Boittiaux, conseillers, Mlle Sant, Mmes Marie, Charruault, conseillers référendaires, M. Graziani, avocat général, Mme Molle-de Hédouville, greffier de chambre ;
Sur le rapport de M. le conseiller Waquet, les conclusions de M. Graziani, avocat général, et après en avoir délibéré conformément à la loi ;
Sur le premier moyen :
Attendu que M. Y..., embauché le 4 mai 1987 en qualité de maçon par M. X..., a été licencié le 4 mars 1988 ; qu'il fait grief au jugement attaqué (conseil de prud'hommes d'Aubenas, 29 septembre 1988) d'avoir retenu trois attestations communiquées seulement au moment de l'audience à son défenseur ;
Mais attendu qu'à défaut de tout incident, la communication desdites attestations, qui ont été soumises à une discussion contradictoire, a été régulière ; que le moyen n'est pas fondé ;
Sur le second moyen :
Attendu que le salarié soutient que la mention du jugement donnant acte à l'employeur du paiement à la barre de la somme de 148,04 francs et de la remise du certificat destiné à la caisse des congés payés serait inexacte ;
Mais attendu que la mention du jugement vaut jusqu'à inscription de faux ; que le moyen ne saurait donc être accueilli ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
! Condamne M. Y..., envers M. X..., aux dépens et aux frais d'exécution du présent arrêt ;
Ainsi fait et jugé par la Cour de Cassation, Chambre sociale, et prononcé par M. le président en son audience publique du huit novembre mil neuf cent quatre vingt dix.
