The high court reviewed an appeal against a decision that sent an individual to the Assize Court for armed robbery and attempted intentional homicide, stemming from a procedural error where the indictment chamber failed to annul an investigative report of a site visit. The court found that during this site visit, the investigating judge questioned the accused and the civil party in a manner that constituted an interrogation, rather than mere material findings, violating the procedural formalities required for such depositions, thus rendering the report null and compelling the quashing of the appellate decision and referral for a new determination.
