Association Appeal on Moot Guarantee Obligation
Synthèse Legislator
Généré par l'IAThe appellant association sought the annulment of a lower court's judgment which affirmed an earlier ruling compelling the association to guarantee the payment of holiday indemnities to an individual, this enforcement judgment having been rendered following a dispute regarding the execution of a decision dated March 20, 1987; however, because the Court of Cassation simultaneously annulled the underlying March 20, 1987 decision, the enforcement judgment being appealed was consequently rendered moot, leading the court to rule that there was no need to rule on the appeal.
