Estate Dispute: Misappropriation of Funds by Attorney-in-Fact
Synthèse Legislator
Généré par l'IAThe case concerns three siblings disputing the estate of their deceased father, where one sibling had been granted bank account powers of attorney by the father and was sued by the others for the reporting of funds. The Court of Cassation upheld the appellate court's decision, which found that the sibling in question had misappropriated funds from the estate without the knowledge of his co-heirs using the powers of attorney, thereby characterizing the fraudulent concealment (recel) under the relevant Civil Code article, which justified ordering the return of those sums to the estate and excluding the sibling from any share therein.

Attendu que Fernand X... est décédé le 23 mai 1996 laissant pour lui succéder ses trois enfants, Mme Fernande X..., épouse Y... et MM. André et Claude X... ; que ce dernier a recueilli son père à plusieurs reprises lequel lui a donné procuration sur divers comptes bancaires ;
Attendu que Mme Y... et M. André X... ont assigné M. Claude X... aux fins de rapport d'une certaine somme à la succession ;
Attendu qu'il est fait grief à l'arrêt attaqué (Caen, 17 février 2004), d'avoir dit que M. Claude X... avait recelé diverses sommes dépendant de la succession de son père, qu'il devra en faire rapport à la masse successorale et ne pourra prétendre à aucune part sur celles-ci ;
Attendu qu'après avoir relevé, dans l'exercice de son pouvoir souverain, que M. Claude X... avait disposé de ces sommes à l'insu de ses cohéritiers, ce qui lui avait été rendu possible par les procurations dont il était titulaire sur les comptes, la cour d'appel a jugé que le recel d'effets de la succession, tel que qualifié par l'article 792 du Code civil se trouvait ainsi caractérisé, de sorte qu'il ne pouvait prétendre à aucune part sur ce montant ; qu'elle a ainsi caractérisé l'intention frauduleuse, élément constitutif du recel ;
D'où il suit que le moyen ne peut être accueilli ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne M. Claude X... aux dépens ;
Ainsi fait et jugé par la Cour de Cassation, Première chambre civile, et prononcé par le président en son audience publique du vingt-huit juin deux mille cinq.
