Appeal Dismissed for Failure to Comply with Procedural Filing Requirements
Synthèse Legislator
Généré par l'IAThe Supreme Court declared an appeal inadmissible because the appellant failed to comply with procedural requirements mandating the filing of both a copy of the challenged appellate decision and its proof of service when lodging the appeal memorandum. Specifically, the appellant only submitted an act showing the bailiff declared territorial incompetence regarding the service of the March 17, 2003, decision, which was insufficient under articles 611-1 and 979 of the Code of Civil Procedure, leading to the dismissal of the appeal for inadmissibility, regardless of the merits of the underlying indemnification claim.
