Municipality Property Expropriation Transfer Appeal Rejection
Synthèse Legislator
Généré par l'IAThe case involved an appeal against an order issued by the expropriation judge concerning the transfer of property to a municipality. The court of cassation rejected the appeal, reasoning that arguments relating to the scope of the compulsory purchase area and the administrative acts preceding the expropriation operation cannot be raised as grounds for an appeal challenging the specific order that pronounces the property transfer, thereby deeming the appellant's two combined grounds for cassation inadmissible.

en cassation d'une ordonnance rendue le 31 mars 1999 par le juge de l'expropriation du Département de la Haute-Savoie, siégeant au tribunal de grande instance d'Annecy, au profit de la commune de Scionzier, représentée par son maire en exercice,
défenderesse à la cassation ;
Le demandeur invoque, à l'appui de son pourvoi, les deux moyens de cassation annexés au présent arrêt ;
LA COUR, composée selon l'article L. 131-6, alinéa 2, du Code de l'organisation judiciaire, en l'audience publique du 16 février 2000, où étaient présents : M. Beauvois, président, M. Cachelot, conseiller rapporteur, Mlle Fossereau, conseiller doyen, M. Weber, avocat général, Mme Berdeaux, greffier de chambre ;
