Divorce Annuity Applicability of Post-Decree Statutory Amendments
Synthèse Legislator
Généré par l'IAA party appealing a decision awarding a compensatory allowance in divorce, partially structured as a monthly annuity for ten years, argued that the appellate court violated recent civil code amendments governing such allowances by not awarding the full amount as capital. The Court of Cassation rejected the appeal, reasoning that because the initial divorce decree became final before the appellate decision, and the appeal only concerned the financial consequences, the new law cited by the appellant was not applicable to the case.

LA COUR DE CASSATION, PREMIERE CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le moyen unique :
Attendu que Mme X... fait grief à l'arrêt attaqué (Bordeaux, 22 février 2000) d'avoir condamné M. Y... à lui payer une prestation compensatoire sous forme d'un capital de 300 000 francs ainsi qu'une rente de 1 000 francs par mois pendant 10 ans, alors, selon le moyen, qu'en fixant partiellement le montant de la prestation compensatoire sous forme de rente sur une période de 10 ans, la cour d'appel a violé les articles 273, 274 du Code civil dans leur rédaction issue de la loi n° 2000-596 du 30 juin 2000 ;
Mais attendu que le divorce, prononcé par jugement du 13 juillet 1998, étant passé en force de chose jugée au jour de l'arrêt attaqué du fait des appels limités aux seules conséquences financières du divorce, les dispositions de la loi précitée n'étaient pas applicables à l'espèce ;
D'où il suit que le moyen n'est pas fondé ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne Mme X... aux dépens ;
Ainsi fait et jugé par la Cour de Cassation, Première chambre civile, et prononcé par le président en son audience publique du dix-sept juin deux mille trois.
