Arbitrator's Jurisdiction Over Competence Versus Judicial Affirmation of Jurisdiction
Synthèse Legislator
Généré par l'IAThe appeal was deemed immediately admissible despite the lower court's decision not definitively ending the proceedings because the appellate court committed an excess of power by affirming the competence of the ordinary courts after a judgment declared those courts incompetent due to an arbitration clause; the appellate court erred in ruling on the merits of the dispute without allowing the arbitrator to rule on their own jurisdiction, which violates the principle that the arbitrator has the authority to rule on their own competence, leading the higher court to quash the appellate decision and declare the ordinary state jurisdiction incompetent.

Texte complet
Sur la recevabilité du pourvoi :
Attendu que la société Cerve France invoque l'irrecevabilité du pourvoi, formé contre un arrêt qui, statuant sur contredit de compétence, n'a pas mis fin à l'instance, la cour d'appel ayant évoqué le litige ;
Mais attendu que le pourvoi est immédiatement recevable en cas d'excès de pouvoir ;
Et sur le moyen unique :
Vu les articles 1458 et 1466 du nouveau Code de procédure civile ;
Attendu que pour accueillir le contredit de compétence formé par la société Cerve France contre un jugement ayant déclaré incompétente la juridiction étatique en raison de la stipulation d'une clause d'arbitrage dans le contrat litigieux, l'arrêt énonce qu'à défaut de véritable différend sur l'interprétation du contrat, il n'y a pas lieu de renvoyer les parties devant la juridiction arbitrale, mais d'affirmer la compétence des juridictions de droit commun ;
Qu'en statuant ainsi, alors qu'il appartenait à l'arbitre de statuer sur sa propre compétence, la cour d'appel a excédé ses pouvoirs ;
Et vu l'article 627, alinéa 2, du nouveau Code de procédure civile ;
Par ces motifs :
CASSE ET ANNULE, dans toutes ses dispositions, l'arrêt rendu le 5 juillet 2001, entre les parties, par la cour d'appel de Douai ;
Dit n'y avoir lieu à renvoi ;
Déclare la juridiction étatique incompétente ;
Renvoie les parties à mieux se pourvoir.
