Interest Accrual Date Dispute in Aviation Injury Case
Synthèse Legislator
Généré par l'IAAn individual injured during a flight lesson sued the instructor, the flying club, and their insurer for damages, and the social security fund sought reimbursement for benefits paid to the victim. The defendants appealed a decision that set the starting date for interest owed to the social security fund from the date of the initial legal claim, arguing that the applicable civil code provision mandates that interest only begin accruing from the date of the judgment. The high court rejected this appeal, reasoning that the Court of Appeal, by setting the interest accrual date at a time other than the judgment date, merely exercised the discretionary power granted by the cited civil code article, thereby legally justifying its decision.

Sur le moyen unique :
Attendu, selon l'arrêt attaqué, que M. Y..., qui avait été blessé au cours d'une leçon de pilotage d'avion, a assigné le moniteur, M. X..., son commettant, l'aéro-club de Méribel et son assureur, la compagnie SM3A, en responsabilité et indemnisation des préjudices ; que la CPAM de la Côte-d'Or (la Caisse), qui avait versé des prestations à la victime en a demandé le remboursement ;
Attendu que M. X..., l'aéro-club de Méribel et la société AGF Marine, aviation, transport, venant aux droits de la compagnie SM3A, font grief à l'arrêt d'avoir fixé le point de départ des intérêts de la somme due à la Caisse à compter de la demande en justice, alors, selon le moyen, qu'en application de l'article 1153-1 du Code civil la condamnation à une indemnité emporte intérêts à compter du prononcé du jugement ; qu'en statuant ainsi la cour d'appel a violé ce texte ;
Mais attendu qu'en fixant à une date, autre que celle de sa décision le point de départ des intérêts la cour d'appel qui s'est fondée sur l'article 1153-1 du Code civil, n'a fait qu'user de la faculté ouverte à sa discrétion et, par ce seul motif, a légalement justifié sa décision ;
D'où il suit que le moyen n'est pas fondé ;
Par ces motifs :
REJETTE le pourvoi.
