Union Candidate Lists in Professional Elections Overturned
Synthèse Legislator
Généré par l'IAThe Court of Cassation overturned a lower court's decision that refused to annul elections for employee representatives and works council members because two local unions affiliated with the same national confederation each presented separate candidate lists. The Court reasoned that under the Labor Code, union organizations within a single enterprise that are affiliated with the same nationally representative confederation may only present a single combined list of candidates under the name of that national confederation during professional elections, thereby finding the lower court violated the relevant statutes and, exercising its power under the Code of Civil Procedure, canceled the elections without referral.

Attendu que pour refuser d'annuler les élections des délégués du personnel et des membres du comité d'entreprise au sein de la société Artenis Propreté qui ont eu lieu le 21 mars 2000, lors desquelles les deux syndicats CFDT présents dans l'entreprise ont présenté chacun une liste de candidats, le jugement attaqué énonce qu'aucun texte n'interdit à deux syndicats affiliés à une même confédération représentative au plan national de présenter des listes de candidats lors d'une élection professionnelle ;
Qu'en statuant ainsi, alors que les syndicats d'une entreprise affiliés à la même confédération représentative sur le plan national ne peuvent présenter qu'une seule liste de candidats au nom de la confédération nationale lors des élections professionnelles dans l'entreprise, le tribunal d'instance a violé les textes susvisés ;
Et attendu qu'en application de l'article 627 du nouveau Code de procédure civile, la Cour de cassation est en mesure, en cassant sans renvoi, de mettre fin au litige par application de la règle de droit appropriée ;
PAR CES MOTIFS :
CASSE ET ANNULE, dans toutes ses dispositions, le jugement rendu le 17 avril 2000, entre les parties, par le tribunal d'instance de Paris 10e ;
DIT n'y avoir lieu à renvoi ;
Annule le second tour des élections des délégués du personnel et des membres du comité d'entreprise qui ont eu lieu le 21 mars 2000 au sein de la société Artenis Propreté.
