Tenant's Right of Substitution After Adjudication Denied
Synthèse Legislator
Généré par l'IAA tenant, who was the lessee of an apartment subsequently adjudicated to the co-ownership association, claimed the right to substitute herself for the association following the adjudication, leading the association to sue to deny this right. The tenant argued that the statutory right of substitution for a lessee following an adjudication, under the second paragraph of the relevant law, was not restricted to sales following the initial division of the building, unlike the first paragraph. However, the appellate court correctly held that because the apartment unit had undergone at least one prior sale since its division, the adjudication in question was not the initial one, thereby precluding the tenant from exercising the right of substitution, leading the high court to reject the appeal.

Sur le moyen unique :
Attendu, selon l'arrêt attaqué (Paris, 26 octobre 1999), que Mlle X..., locataire d'un appartement adjugé au syndicat des copropriétaires de l'immeuble, a déclaré se substituer à ce syndicat ; que le syndicat a assigné Mlle X... pour faire dire qu'elle ne bénéficiait pas du droit de préemption ;
Attendu que Mlle X... fait grief à l'arrêt d'accueillir cette demande, alors, selon le moyen, que si le paragraphe I de l'article 10 de la loi du 31 décembre 1975 n'ouvre au profit du locataire un droit de substitution que dans le cas d'une vente consécutive à la division initiale ou à la subdivision de tout ou partie d'un immeuble par lots, le paragraphe II du même article qui concerne la vente par adjudication ne comporte pas une telle restriction, qu'ainsi l'arrêt attaqué a violé l'article 10-II de la loi du 31 décembre 1975 et l'article 455 du nouveau Code de procédure civile ;
Mais attendu qu'ayant constaté que le lot avait fait l'objet d'au moins une vente depuis sa division, la cour d'appel a retenu, à bon droit, que l'adjudication n'était pas consécutive à la division initiale de l'immeuble et que Mlle X... ne pouvait exercer un droit de substitution ;
D'où il suit que le moyen n'est pas fondé ;
PAR CES MOTIFS :
REJETTE le pourvoi.
