A dispute arose between a lawyer and a professional civil partnership concerning the reimbursement of mandatory professional contributions as stipulated in their collaboration contract, which included a clause mandating prior amicable resolution before the bâtonnier (head of the local bar) in case of serious disagreement. When the lawyer subsequently sued for unpaid contributions, the partnership argued that the claim for contributions prior to the five-year limitation period should be time-barred, asserting that only formal legal acts listed in the Civil Code could interrupt prescription. The court rejected this appeal, reasoning that because the parties were contractually bound to the preliminary conciliation procedure before the bâtonnier, the initiation of this obligatory procedure effectively suspended the running of the statutory limitation period until its conclusion, thereby validating the lawyer's action.

AU NOM DU PEUPLE FRANCAIS

LA COUR DE CASSATION, PREMIERE CHAMBRE CIVILE, a rendu l'arrêt suivant :

Sur le moyen unique :

Attendu que Mme Brigitte X..., avocate, a conclu avec la SCP Y... un contrat de collaboration prévoyant, notamment, qu'elle percevrait à titre de rétrocession d'honoraires complémentaire le paiement de certaines cotisations obligatoires auxquelles elle se trouvait assujettie ; que la convention des parties disposait par ailleurs qu'elles soumettraient leur différend au bâtonnier du barreau d'Evreux en cas de mésentente grave ; que, par lettre du 17 juin 1993, Mme X... a saisi ce bâtonnier du différend qui l'opposait à la SCP Y... et portant, notamment, sur le paiement de diverses cotisations qui ne lui auraient pas été réglées ; que l'intervention du bâtonnier, qui s'est poursuivie jusqu'en 1996, n'a pas permis de trouver une solution amiable et que Mme X... a fait assigner, le 4 juin 1997, M. Y... et la SCP Y... qui ont opposé, pour les cotisations antérieures au 4 juin 1992, la prescription quinquennale prévue à l'article 2277 du Code civil ;

Attendu que M. Y... et la SCP Y... font grief à l'arrêt confirmatif attaqué (Rouen, 13 septembre 2000) d'avoir déclaré non prescrite l'action de Mme X... alors que la prescription ainsi que le délai pour agir n'étant interrompus que par une citation en justice, un commandement ou une saisie signifiée à celui que l'on veut empêcher de prescrire et cette énumération étant limitative, la cour d'appel aurait violé l'article 2244 du Code civil ;

Mais attendu qu'ayant retenu que la clause conventionnelle de conciliation devant le bâtonnier, s'imposait aux parties, l'arrêt attaqué en a justement déduit que ce préalable de conciliation était obligatoire avant l'introduction d'une procédure contentieuse et que, dès lors, sa mise en oeuvre avait suspendu jusqu'à son issue le cours de la prescription ; que le moyen n'est pas fondé ;

PAR CES MOTIFS :

REJETTE le pourvoi ;

Condamne M. Y... et la SCP Y... et Stefani aux dépens ;

Ainsi fait et jugé par la Cour de Cassation, Première chambre civile, et prononcé par le président en son audience publique du vingt-sept janvier deux mille quatre.
