Traffic Accident Victim's Hepatitis C Infection: Transfusion Center Indemnity Claim Against At-Fault Driver
Synthèse Legislator
Généré par l'IAAn individual, injured in a 1985 traffic accident caused by another party, contracted Hepatitis C following necessary blood transfusions, leading them to sue the blood transfusion center (now represented by the French Blood Establishment) for compensation. The transfusion center sought indemnity from the at-fault driver, but the Court of Appeal rejected this claim, reasoning that the contamination stemmed solely from a fault attributable to the center, independent of the initial accident. The high court quashed this part of the judgment, holding that because the transfusions were necessitated by the traffic accident, the lower court erred in precluding the center from seeking indemnity from the driver responsible for the initial injuries.

Texte complet
Met hors de cause, sur sa demande, le Centre départemental de transfusion sanguine Union mutualiste tarnaise ;
Sur le premier moyen, pris en sa seconde branche :
Vu l'article 1382 du Code civil ;
Attendu que les blessures subies, en 1985, par M. X... à l'occasion d'un accident de la circulation imputable à M. Y... ont rendu nécessaires des interventions chirurgicales et des transfusions sanguines ; qu'une contamination par le virus de l'hépatite C ayant été diagnostiquée, en 1990, M. X... en a imputé l'origine aux transfusions faites avec des produits sanguins fournis par le Centre de transfusion sanguine de Montpellier (le CRTS), aux droits duquel vient l'Etablissement français du sang ; que le CRTS a appelé en garantie M. Y... ;
Attendu que, pour rejeter cette demande en garantie, l'arrêt relève, par motifs adoptés, que si les produits sanguins administrés avaient été exempts de vices, la contamination n'aurait pas eu lieu, bien qu'il y ait eu accident, de sorte que le CRTS ne pouvait répercuter sur l'auteur de l'accident une faute qui lui incombait personnellement et qui était seule à l'origine de la contamination ;
Attendu qu'en se prononçant ainsi, alors que les transfusions sanguines ayant entraîné la contamination avaient été rendues nécessaires par l'accident imputable à M. Y..., la cour d'appel a violé le texte susvisé ;
