Jurisdiction in Paternity Suit Based on Plaintiff's French Nationality Despite Foreign Law Prohibition
Synthèse Legislator
Généré par l'IAA national of another country challenged the jurisdiction of the French court in a paternity suit brought by a woman with dual nationality, arguing that French jurisdiction, based on the plaintiff's French nationality under Article 14 of the Civil Code, violated the fundamental principle of national identity because Moroccan law prohibits judicial recognition of natural paternity. The court rejected the appeal, holding that the jurisdictional rule of Article 14 of the Civil Code applies to the French judge unless excluded by an international treaty, and the Franco-Moroccan treaty did not concern filiation matters, thus confirming jurisdiction based solely on the plaintiff's French nationality, while also deeming the argument regarding implied renunciation of this benefit inadmissible as a new issue.

Généré par l'IAThe court confirmed that Article 14 of the Civil Code, establishing jurisdiction for French plaintiffs, was applicable and could not be set aside by the Franco-Moroccan Convention.
The court held that this Convention did not apply to filiation actions, thus not invalidating the application of Article 14 of the Civil Code.
This provision was invoked by the appellant in the first branch of the appeal ground, but the court's rejection implies it did not find a violation thereof in the context of the applicable provisions.
This article is implicitly referred to as the basis for declaring the second branch of the appeal inadmissible because it was new and mixed with facts and law (although not explicitly cited in the dispositive, it is the typical procedural basis for declaring a plea inadmissible when the text states 'nouveau et mélangé de fait et de droit, le moyen est irrecevable'). However, adhering strictly to the rules, since no procedural article is explicitly cited in the dispositive orders (which only contain 'REJETTE le pourvoi'), only the substantive articles whose application was confirmed or rejected in the reasoning leading to the rejection should be included if they were the core grounds of the decision.
Although not explicitly cited in the dispositive, the finding that the second part of the appeal ground was 'irrecevable' based on being 'nouveau et mélangé de fait et de droit' corresponds to the standard application of procedural rules for inadmissibility in the Cour de cassation, which is the actual procedural outcome implied by the rejection.
Texte complet
Sur le moyen unique, pris en ses deux branches :
Attendu que, le 15 juin 1997, Mme Y..., ayant la double nationalité française et marocaine, a mis au monde à Chene-Bougeries (canton de Genève) une fille prénommée Ilyane ; que, par acte du 26 mars 1998, elle a assigné M. X..., de nationalité marocaine, en déclaration de paternité naturelle ; que celui-ci a soulevé l'exception d'incompétence de la juridiction française laquelle s'est déclarée compétente par application de l'article 14 du Code civil ;
Attendu que M. X... fait grief à l'arrêt attaqué (Paris, 10 novembre 1999) d'avoir rejeté son contredit, alors, selon le moyen :
1° qu'en statuant ainsi, sans vérifier si la saisine du tribunal français et les conséquences en découlant quant à la détermination de la loi applicable au fond étaient compatibles avec l'interdiction absolue faite, en droit marocain, de toute recherche de paternité naturelle, la cour d'appel n'a pas respecté le principe fondamental de l'identité nationale de Mme Y... et de la sienne, violant ainsi la Convention franco-marocaine du 10 août 1981 et l'article 14 du Code civil, ensemble l'article 55 de la Constitution ;
2° qu'en tout état de cause, il avait rappelé, devant les juges du fond, que Mme Y..., en raison de sa nationalité marocaine et de sa religion musulmane, devait être considérée comme ayant fait acte d'" allégeance " au droit marocain qui prohibe toute recherche judiciaire de paternité naturelle ; qu'en omettant de vérifier si une telle allégeance n'emportait pas renonciation implicite au bénéfice de l'article 14 du Code civil, la cour d'appel a privé sa décision de base légale au regard de ce texte ;
Mais attendu que la règle de compétence édictée au profit du demandeur français par l'article 14 du Code civil s'impose au juge français et ne peut être écartée, si son bénéficiaire ne renonce pas à s'en prévaloir, que par un traité international ; que, par motif adopté, la cour d'appel a décidé exactement que la Convention franco-marocaine du 10 août 1981 ne concernait pas les actions relatives à la filiation et qu'elle ne pouvait donc écarter l'application de l'article 14 du Code civil dont bénéficie Mme Y... du fait de sa nationalité française, seule prise en considération par les tribunaux français ;
Et attendu qu'il ne résulte nullement du contredit que M. X... ait soutenu, devant la cour d'appel, le moyen tiré de la renonciation de Mme Y... au bénéfice de l'article 14 du Code civil ; d'où il suit que, nouveau et mélangé de fait et de droit, le moyen est irrecevable ;
PAR CES MOTIFS :
REJETTE le pourvoi.
