Guarantor Subrogation Rights Against Sub-Guarantor
Synthèse Legislator
Généré par l'IAA financial institution, having acted as a joint and several guarantor for a loan and subsequently paid the remaining debt, sought reimbursement from an individual who had provided a personal guarantee for the institution's sole benefit, which the lower court upheld. The guarantor appealed, arguing that the paying guarantor could not seek recourse against the sub-guarantor if the principal debtor could have extinguished the debt at the time of payment, citing a provision meant to protect the principal debtor against a non-notified paying guarantor. The highest court rejected the appeal, reasoning that in the relationship between the principal debtor, the primary guarantor, and the sub-guarantor, the latter must be treated identically to a guarantor and thus cannot invoke the cited code article against the paying guarantor, as that provision is solely available to the principal debtor.

Généré par l'IAThe court implicitly confirmed the Court of Appeal's decision by finding that the specific provision cited by the appellant (Art. 2031 al. 2) could not be invoked by the sub-guarantor against the guarantor who paid.
Cited implicitly because the rejection of the appeal leads to the application of the procedural consequence for costs or rejection.

Donne acte à Mme X... du désistement de son pourvoi à l'égard de la Banque de Picardie ;
Attendu que le Crédit d'équipement des petites et moyennes entreprises (Cepme), qui avait garanti le remboursement d'un emprunt par son cautionnement solidaire, a, après avoir payé les sommes restant dues au prêteur, demandé à Mme X..., qui s'était, à concurrence de 100 000 francs, portée caution solidaire à son seul bénéfice, l'exécution de son propre engagement ; que l'arrêt confirmatif attaqué (Reims, 16 décembre 1998) a accueilli cette prétention ;
Sur le premier moyen, pris en sa première branche :
Attendu que Mme X... fait grief à l'arrêt d'avoir ainsi statué, alors que, lorsque la caution aura payé sans être poursuivie et sans avoir averti le débiteur principal, elle n'aura point de recours contre lui dans le cas où, au moment du paiement, ce débiteur aurait eu les moyens pour faire déclarer la dette éteinte ; que cette disposition qui s'applique aussi bien à l'action personnelle qu'à celle fondée sur la subrogation, bénéficie à la sous-caution, de sorte que celle-ci n'est tenue que dans la mesure où la caution est créancière du débiteur principal, de sorte qu'en statuant comme elle l'a fait, la cour d'appel aurait violé l'article 2031, alinéa 2, du Code civil ;
Mais attendu que, dans les rapports existant entre le débiteur principal, la caution et la sous-caution, cette dernière doit, à tous égards, être traitée comme une caution, en sorte qu'elle ne peut se prévaloir, contre la caution qui a payé le créancier, des dispositions de l'article 2031 du Code civil que seul le débiteur est en droit d'invoquer ; que c'est donc, à bon droit, que l'arrêt, par motifs adoptés, a statué comme il l'a fait ; que le moyen, en sa première branche, n'est pas fondé ;
Et sur les deux dernières branches du premier moyen, et sur le second moyen, pris en ses deux branches : (Publication sans intérêt) ;
Par ces motifs :
REJETTE le pourvoi.
