Apprentice Compensation Upon Liquidation Termination
Synthèse Legislator
Généré par l'IAIn a case where an employer underwent judicial liquidation, an apprentice sued for damages following the termination of their apprenticeship contract by the liquidator, seeking compensation equivalent to the wages they would have received until the contract's end. The appellate court incorrectly dismissed the claim, reasoning that the definitive cessation of activity ordered by the commercial court precluded the application of the relevant labor code provisions concerning termination indemnity. The high court overturned this decision, holding that the liquidator acts in execution of the liquidation judgment when terminating the apprenticeship contract, and consequently, the apprentice is statutorily entitled to compensation equal to the wages due until the contract's original term.

Sur les deux moyens réunis :
Attendu qu'il résulte des dispositions combinées des articles 148-4, alinéa 4, et 153, alinéa 2, de la loi du 25 janvier 1985 et L. 117-17 du Code du travail, qu'en cas de liquidation judiciaire de l'employeur, le liquidateur, qui met fin au contrat d'apprentissage agit en exécution du jugement de liquidation et n'a pas à demander au conseil de prud'hommes la résiliation du contrat ; que dans ce cas, l'apprenti a droit à une indemnité égale aux rémunérations qu'il aurait perçues jusqu'au terme de son contrat ;
Attendu que l'apprenti a saisi la juridiction prud'homale en réclamant la fixation de sa créance indemnitaire à une somme égale au montant des salaires qu'il aurait dû percevoir jusqu'à la fin du contrat ;
Attendu que pour débouter l'apprenti de ses demandes, l'arrêt attaqué retient que, le tribunal de commerce ayant prononcé la liquidation judiciaire de la société et décidé la cessation définitive de l'activité, il ne peut être fait application de l'article L. 117-17 et qu'il y a lieu de débouter M. X... de ses demandes indemnitaires ;
Qu'en statuant ainsi, la cour d'appel a violé les textes susvisés ;
