Court of Cassation Quashes Decision Misapplying Moroccan Law in Traffic Accident Case
Synthèse Legislator
Généré par l'IAThe Court of Cassation quashed a lower court decision that had disregarded the application of Moroccan law, as designated by the Hague Convention of May 4, 1971, regarding a traffic accident that occurred in Morocco, by instead applying a 1985 law on improving the situation of accident victims and accelerating compensation procedures. The reasoning was that the Convention explicitly determines the applicable law for both civil liability and the extent of reparation, regardless of the basis, provided it is non-contractual, meaning the appellate court violated the Convention by mischaracterizing the scope of the French law applied.

Sur le moyen unique :
Vu l'article 1er de la convention de La Haye du 4 mai 1971 sur la loi applicable en matière d'accidents de la circulation routière ;
Attendu que cette convention détermine la loi applicable tant à la responsabilité civile qu'aux modalités et à l'étendue de la réparation, quel qu'en soit le fondement, à condition qu'il soit extra-contractuel ;
Attendu que pour écarter l'application de la loi marocaine désignée par la Convention précitée, s'agissant d'un accident survenu au Maroc, l'arrêt attaqué énonce que Mme X..., victime transportée, avait droit à l'indemnisation totale de son préjudice par application de la loi du 5 juillet 1985, qui n'est pas une loi de responsabilité, mais une loi " tendant à l'amélioration de la situation des victimes d'accidents de la circulation et à l'accélération des procédures d'indemnisation " ;
En quoi la cour d'appel a violé le texte susvisé ;
