Lender v. Borrower Regarding Vehicle Loan and Estoppel from Non-Delivery Claim
Synthèse Legislator
Généré par l'IAAn individual borrowed funds from a financial institution to purchase a vehicle, signing both the loan agreement and a delivery and fund release certificate addressed to the seller, based on which the lender paid the garage; following the garage's judicial liquidation and the borrower's subsequent default after making initial payments, the lender sued for the outstanding balance, and the appellate court affirmed the judgment ordering the borrower to pay, because the court reasoned that a borrower who induces the lender to disburse funds to the seller by signing a delivery certificate is estopped from later asserting non-delivery to the detriment of the lending institution.

Sur le moyen unique, pris en ses deux branches :
Attendu que, suivant offre du 9 novembre 1994, la banque Sygma a consenti un prêt à Mme X... afin de financer l'achat d'un véhicule automobile ; que, le même jour, cette dernière a signé une reconnaissance de livraison et acceptation de déblocage des fonds au vendeur ; que, sur la foi de ce bon de livraison, l'établissement de crédit a payé au garage Société européenne d'automobiles le montant du prêt ; que l'emprunteuse a régulièrement payé les mensualités de remboursement du crédit jusqu'à septembre 1995 ; que, le 29 mai 1995 a été prononcée la liquidation judiciaire de la Société européenne d'automobiles ; qu'à la suite de la défaillance de l'emprunteuse, la banque l'a assignée en paiement ; que la cour d'appel, par arrêt confirmatif (Aix-en-Provence, 17 mars 1999), a condamné Mme X... au paiement du solde dû ;
Attendu que l'emprunteur, qui détermine l'établissement de crédit à verser les fonds au vendeur au vu de la signature par lui du certificat de livraison du bien, n'est pas recevable à soutenir ensuite, au détriment du prêteur, que le bien ne lui avait pas été livré ; d'où il suit que le moyen ne peut être accueilli en aucune de ses branches ;
PAR CES MOTIFS :
REJETTE le pourvoi.
