President of General Council v. Child Protection Services Placement Order
Synthèse Legislator
Généré par l'IAThe President of the General Council of a department appealed a court of appeal decision that placed a minor under the supervision of the departmental social action service and mandated placement in a foster family, arguing the decision lacked sufficient reasoning and constituted an abuse of power, violating civil code articles concerning child protection measures. The high court rejected the appeal, affirming that ordering placement in a foster family is a valid specific obligation under the relevant civil code article that the children's judge can impose when entrusting a minor to child welfare services under another specified article.

Sur les deux moyens réunis :
Attendu que le président du Conseil général du Loir-et-Cher reproche à la cour d'appel (Orléans, 5 mars 1999) d'avoir assorti le placement de la mineure Ionela X... à la direction départementale de l'Action sociale et de la Solidarité d'une orientation en famille d'accueil par une décision insuffisamment motivée et qui violerait par excès de pouvoir les articles 375-2, 375-3 et 375-4 du Code civil ;
Mais attendu que la cour d'appel a exactement décidé, par motifs propres et adoptés, qu'une orientation en famille d'accueil, sans autre indication, était l'une des obligations particulières, au sens de l'article 375-2 du Code civil, dont le juge des enfants peut assortir la remise du mineur au service de l'Aide sociale à l'enfance auquel il le confie par application de l'article 375-3 du même Code ; d'où il suit qu'aucun des moyens n'est fondé ;
PAR CES MOTIFS :
REJETTE le pourvoi.
