Sur le premier moyen :
Attendu, selon l'arrêt attaqué (Amiens, 19 mars 1992), que M. X..., notaire, propriétaire de locaux à usage professionnel, a promis de les donner à bail pour 5 ans, renouvelable par tacite reconduction d'année en année, à compter de sa prestation de serment, à M. Y..., auquel il a cédé son étude ; que le contrat de location, venu à expiration le 26 juin 1985, s'est poursuivi tacitement ; que, le 16 décembre 1987, le propriétaire a délivré congé au locataire pour le 26 juin 1988 et l'a assigné pour faire déclarer le congé valable et ordonner son expulsion ;
Attendu que les époux X... font grief à l'arrêt de déclarer que les locaux sont soumis aux dispositions de la loi du 1er septembre 1948, alors, selon le moyen, que sont assimilés aux logements construits ou achevés postérieurement au 1er septembre 1948, au sens de l'article 3 de la loi du 1er septembre 1948, ceux qui résultent de travaux ayant pour effet de créer de nouveaux locaux d'habitation ou d'augmenter la surface habitable totale, sans qu'il y ait lieu de distinguer suivant que les locaux sont loués à usage d'habitation ou à usage professionnel ; qu'en décidant le contraire, la cour d'appel a violé le texte susvisé ;
Mais attendu que la cour d'appel a retenu, à bon droit, que l'alinéa 4 de l'article 3 de la loi précitée ne concernait que les locaux à usage d'habitation et ceux à usage mixte professionnel et d'habitation ;
D'où il suit que le moyen n'est pas fondé ;
Sur le second moyen : (sans intérêt) ;
