An employer union challenged a lower court's annulment of a first-round election for employee representatives, arguing that the court erred by not ruling on the validity of the collective agreement clause excluding employees stationed abroad from eligibility, and by not recognizing the eligibility of the employee in question, who remained directly employed by the company but worked in Saudi Arabia, despite the exclusion clause allegedly violating mandatory French labor law articles regarding employee representation. The Court of Cassation upheld the annulment, reasoning that the lower court's decision was legally justified because, although French representation law applies to companies in France, the employee's physical distance and the local law prohibiting representative functions in Saudi Arabia meant the individual could not effectively fulfill the mandate within the establishment located in France.

X... était toujours salarié direct de Navfco, remplissait les conditions d'éligibilité de l'article L. 423-8 du Code du travail ; que le Tribunal a violé ce texte et l'article 6, paragraphes 1 et 2 de la Convention sur la loi applicable aux obligations contractuelles signée à Rome le 19 juin 1980 et publiée par décret du 28 février 1991 ;

Mais attendu que, si la législation française relative à la représentation du personnel s'applique à toute entreprise située en France, le tribunal d'instance, qui a relevé que la loi locale interdisait au salarié d'exercer des fonctions représentatives en Arabie Saoudite, a également fait ressortir que son éloignement ne permettrait pas à l'intéressé de remplir son mandat dans l'établissement situé en France ; qu'il a ainsi, sans méconnaître les termes du litige, légalement justifié sa décision ;

PAR CES MOTIFS :

REJETTE le pourvoi.
