An administrative review led to the reinstatement of a 20% supplementary abatement for professional expenses within the contribution base for an employer's transport company, which had applied this deduction to its bus drivers' remuneration for the years 1984 to 1986. The appellate court had upheld the annulment of the reassessment, reasoning that because the drivers fell under a specific article of the general tax code granting them a 20% abatement, the employer was authorized to apply an identical deduction to social security contributions, irrespective of whether the employees actually used that tax faculty. The high court quashed this decision, ruling that the appellate court failed to ascertain whether the tax administration, given the concrete situation of the employees, permitted them to benefit from the supplementary professional expense deduction during that period, a necessary condition for the employer to be authorized to apply a corresponding abatement to the contribution base.

Sur le moyen unique :

Vu l'article L. 120 du Code de la sécurité sociale (ancien), devenu l'article L. 242-1 de la nouvelle codification, et l'article 4 de l'arrêté interministériel du 26 mai 1975 ;

Attendu qu'à la suite d'un contrôle, l'URSSAF a réintégré, dans l'assiette des cotisations dues par la société Transports Bigorre-Pyrénées pour les années 1984 à 1986, l'abattement supplémentaire de 20 % pour frais professionnels que ladite société avait pratiqué sur les rémunérations de certains de ses chauffeurs de car ;

Attendu que, pour annuler ce redressement, l'arrêt attaqué énonce que les chauffeurs de car intéressés figurent dans le tableau de l'article 5 de l'annexe IV du Code général des impôts et qu'ayant droit, en vertu de ce texte, à un abattement supplémentaire de 20 %, l'employeur était autorisé à pratiquer une déduction identique sur l'assiette des cotisations, peu important que les salariés aient ou non usé de cette faculté ;

Qu'en statuant ainsi, sans rechercher si l'administration fiscale admettait qu'en fonction de leur situation concrète les salariés concernés pouvaient bénéficier, pour la période en cause, d'une déduction supplémentaire pour frais professionnels, condition nécessaire pour que l'employeur soit autorisé à pratiquer un abattement de même montant sur l'assiette des cotisations, la cour d'appel n'a pas donné de base légale à sa décision ;
