Appeal Reinstatement Due to Execution of Judgment
Synthèse Legislator
Généré par l'IAIn an appeal proceeding initially struck from the court's roll in 1991, the opposing party requested a declaration of abandonment due to inaction, but the appellants opposed this, arguing they had executed the appellate court's judgment. The court found that the appellants' dispatch of a significant payment in 1991 demonstrated an unequivocal intention to comply with the ruling, which effectively interrupted the statutory period for abandonment, and since the appellants subsequently proved full execution of the obligations imposed upon them, the court authorized the reinstatement of the appeal to the active roll.

Attendu que, par décision du 26 mars 1991, Nous avons ordonné en application de l'article 1009-1 du nouveau Code de procédure civile, le retrait, du rôle de la Cour, de l'instance ouverte sur la déclaration de pourvoi formée le 4 septembre 1990 par les époux X... à l'encontre d'un arrêt rendu le 15 juin 1990 par la cour d'appel de Versailles et inscrite sous le n° 90-19.069 ;
Attendu que, par requête du 13 septembre 1993, les époux Y... Nous ont demandé de constater la péremption du pourvoi n° 90-19.069 ;
Attendu que les époux X... s'opposent à cette mesure et nous demandent de réinscrire le pourvoi au rôle au motif qu'ils ont exécuté l'arrêt de la cour d'appel ;
Attendu qu'il n'est pas contesté que dès le 5 décembre 1991, les époux X... ont adressé aux époux Y..., par l'intermédiaire de leurs conseils respectifs, un chèque d'un montant de 182 533,85 francs ;
Attendu que ces diligences, qui ont abouti à des réglements significatifs, manifestant sans équivoque une volonté d'exécution, ont interrompu la péremption ;
Attendu que les époux X... justifient depuis avoir exécuté la totalité des condamnations mises à leur charge ;
Que dès lors, il y a lieu d'accueillir la requête en réinscription ;
PAR CES MOTIFS :
CONSTATONS l'interruption de la péremption ;
AUTORISONS la réinscription, au rôle de la Cour, du pourvoi n° 90-19.069.
