Noise Disturbance Liability in Semi-Detached Housing
Synthèse Legislator
Généré par l'IAThe occupants of one half of a semi-detached house sued the occupants of the other half for compensation due to abnormal neighborhood noise disturbances, specifically "banging" sounds. The appellants argued the appellate court failed to legally establish the direct responsibility of one specific occupant, given contrary findings regarding the physical ability of the occupants to produce the noise, thereby invalidating the finding of joint and several liability under civil liability rules. The highest court dismissed the appeal, holding that the appellate court correctly held the occupants jointly and severally liable based on the established fact that the abnormal noises originated from the portion of the dwelling they occupied.

Sur le moyen unique :
Attendu, selon l'arrêt confirmatif attaqué (Versailles, 6 mars 1992), que les époux Y..., qui occupent moitié d'un pavillon dont les époux X... et leurs fils occupent l'autre moitié, se plaignant de bruits provenant de la partie habitée par ceux-ci, les ont assignés en réparation de troubles anormaux de voisinage ;
Attendu qu'il est fait grief à l'arrêt d'avoir condamné in solidum les consorts X... à dommages-intérêts, alors que, d'une part, la cour d'appel qui aurait dû caractériser la participation effective de M. André X... aux " cognements " sonores, s'est prononcée par le motif dubitatif selon lequel " le bruit émane probablement d'André X... " ; qu'elle aurait ainsi privé sa décision de base légale au regard de l'article 1382 du Code civil ; alors que, d'autre part, il n'y a de responsabilité in solidum entre les membres d'un groupe qu'autant que le comportement de chacun d'eux a été en relation directe avec le dommage ; que, dès lors, la cour d'appel, qui a retenu la responsabilité des époux X..., non sans avoir au préalable constaté leur inaptitude physique à produire les " cognements sonores " eu égard à leur âge et leur état de santé, aurait derechef privé sa décision de base légale au regard de l'article 1382 du Code civil ;
Mais attendu que l'arrêt, qui a constaté que les bruits anormaux perçus par les consorts Y... provenaient de la partie du pavillon occupée par les consorts X..., a exactement décidé que ces derniers devaient être déclarés in solidum responsables ;
D'où il suit que le moyen n'est pas fondé ;
PAR CES MOTIFS :
REJETTE le pourvoi.
